Besides he is just authorized to the practice of the right to keep back as far as his counter-claim rest on the same contractual relationship. § 6 Property reservation Until the completely payment from all claims, which exist against the orderer, the delivered ware rests as property by BLIX – der neue Selbstverlag. § 7 Warrant of merchantability and liability Exist a defect which can be represented by BLIX – der neue Selbstverlag, is BLIX – der neue Selbstverlag with own choice able to the removal of defects or compensation delivery. Is BLIX – der neue Selbstverlag not prepared to the removal of defects/compensation delivery or not able to this or it delays about suitable respites for reasons which BLIX – der neue Selbstverlag has to represent or fail the removal of defects/compensation delivery in other wise, the orderer is able with his choice to withdraw from the contract or to demand an appropriate reduction from the purchase price. As far as there is nothing else add up below, advanced pretensions from the orderer are barred – whatever there are other cause in law. § 8 Rights of use 1. The wares offered from BLIX – der neue Selbstverlag are only uses for the private handling. The copyright keeps at BLIX – der neue Selbstverlag. 2. The copy from the books (even in extracts) is not allowed for the commercial use. § 9 Data protection The orderer is detailed told about the kind, comprehension, place and function of the promotion, processing and using from the necessary individual-related data, which are need for the finish of the order, by BLIX – der neue Selbstverlag. The orderer agree explicitly to the promotion, processing and using. BLIX – der neue Selbstverlag is authorized to save the data from the orderer electronic and to work with them. BLIX – der neue Selbstverlag only use the data for business relations to the customer. § 10 Severability clause If several regulations of the contract, including this arrangement, should be disable, whole regulations or just pieces of them, or should the contract contained a hole, this will not affect the validity from the other regulations.
